(AXcess News) Could the third time be the charm for former Credit Suisse First Boston investment banking star, Frank Quattrone A federal appeals court raised that possibilitylast week when it tossed out Quattrone's 2004 conviction on obstruction of justice charges. His first trial, in 2003, ended with a divided jury. In a unanimous ruling, a federal appellate panel ruled that jury instructions were "flawed, " and chided Judge Richard Owen, who presided over the Quattrone trial, for making comments which went "beyond mere impatience or annoyance with the defense."
Investment Opportunity (AXcess News) Houston, TX - The fraud trial of Enron founder Kenneth Lay and its former CEO Jeffrey Skilling is slated to begin this week with the selection of a jury from amongst 100 juror candidates. The challenge will be to pick jurors who do not already think that Lay and Skilling are thieves and crooks, following the massive amount of publicity the charges against the two ex-Enron executives has brought.
Guess where I'm at At the Anne Arundel Circuit Court house sitting and waiting in the jury room. Yep, called to jury duty beginning today and on call for the next 7 days unless I get on a jury trial sooner or dismissed. We'll see how things go.
Banc Of America Investment Last week, Daniel Petrocelli tried a last-ditch effort to move Skilling's trial to another location, though he was unsuccessful in his attempt. After the move failed, Petrocelli said, "If we get 12 people who haven't made up their minds, we like our chances."
Dell agrees and you agree to waive, to the maximum extent permitted by law, any right to a jury trial with respect to the Software or this agreement.
Banking Investment Petrocelli believes that Skilling has a shot at beating the fraud charges brought from the fall of the nation's largest energy company, Enron, if a jury can be selected that's not hostile.
Florida's pension fund lost $335 million on its Enron investments, more than any other public entity.
Investment Solution Strategic Lay's lawyer, Michael Ramsey, is less optimistic, believing that there is very little chance of picking a jury that will give his client, former Enron founder Kenneth Lay, a fair trial in Houston.
If a jury trial is demanded, some jurisdictions require there to be a mandatory settlement conference. Both the owner and the tenant are required to attend the settlement conference and the court hopes to resolve the issue without a trial. If the issue cannot be resolved, then the action will proceed to trial. The Trial At the trial, each side will present there side of the story. Take any evidence which will help to prove your case to the judge or the jury, such as copies of your lease, rent payment receipts, witnesses, or any other documentation or information that helps to prove your case. After all of the evidence has been presented, the judge or the jury will make a ruling. Unlawful detainer trials generally take about 2 hours.
Investment Banking Services The biggest challenge will be selecting a jury that goes on what they hear in court, not what they heard from the media. An even tougher challenge in selecting a Houston jury will be finding jurors who do not know someone who either worked at Enron or was indirectly connected or affected by the fall of the company four years ago.
Bank Investment The trial itself will be conducted over the largest fraud ever perpetrated by a corporation in the history of the United States, so even without hostile jurors, the attorneysRamsy and Petrocelli both face a challenging case.
Alternative Investment U.S. District Judge Sim Lake told the attorneys he expects a panel of jurors to be seated Monday when the court's day ends. Twice Lake has turned down attorneys attempts to move the trial, unconvinced that a qualified jury couldn't be selected in Houston.
Online Investment Services It will be Judge Lake who asks jury candidates the questions, not the two defense attorneys. "I'll ask the questions in a neutral, non-argumentative manner," Lake said.
Accompany Essential Investment In other high-profile cases jury selection took several days. But if the jury turns out to be biased, an appellate court could send the case back to be retried all over again. Judge Lake's decision to handle jury selection may be good for getting the trial off the ground, but in the long run it might hurt the government's case.
Investment Company Skilling faces 31 counts of fraud, conspiracy, insider trading and lying to auditors for allegedly lying about Enron's financial state before the company crashed. Lay faces seven counts of fraud and conspiracy for allegedly perpetuating the scheme after Skilling resigned in August 2001.
